Terms & Regulatory Status
Scope of services, fees, regulatory status and complaints.
1. Regulatory status
Filippi Legal Consultancy ("the Consultancy") provides unregulated legal services in England and Wales.
- The Consultancy is not a firm of solicitors or barristers. No person at the Consultancy holds a practising certificate as a solicitor or barrister, and the Consultancy does not represent itself as regulated.
- It is not authorised or regulated by the Solicitors Regulation Authority, the Bar Standards Board, or any other legal services regulator.
- It does not carry out reserved legal activities under the Legal Services Act 2007. These include rights of audience, the conduct of litigation, reserved instrument activities, probate activities, notarial activities and the administration of oaths. Where a matter requires any of these, an authorised person is needed, and this will be identified at the outset.
- Communications are not protected by legal professional privilege, which attaches to advice from regulated lawyers. This may be significant if a matter later becomes contentious.
- Immigration advice and immigration services are not provided in any form, paid or unpaid, in any language. Such work may only be carried out by regulated advisers.
- The Consultancy is outside the Legal Ombudsman scheme. Complaints are handled under its own written complaints procedure and clients retain all rights available to them at law.
2. Client protections
- Professional indemnity insurance. The Consultancy maintains professional indemnity cover of not less than £100,000 per claim. The cover applying to a matter is confirmed in the engagement letter.
- Written engagement letter. Every matter begins with a written engagement letter setting out scope, fees, timescales and limitations before work begins.
- Consumer rights. Where the client contracts as a consumer, statutory rights under the Consumer Rights Act 2015 apply, including the requirement that services be carried out with reasonable care and skill. Cancellation rights under the Consumer Contracts Regulations 2013 may also apply, as set out in the engagement letter.
- Data protection. Personal data is handled in accordance with UK GDPR and the Data Protection Act 2018. See the privacy notice.
- No client money. Client funds are not held on account. Invoices are issued for work completed.
3. Website terms of use
Information, not advice
Content on this website is general information about the law and about the services offered. It is not legal advice, does not take account of individual circumstances, and should not be relied on as a substitute for advice on a specific situation. Reading this website, making contact, or receiving an initial reply does not create a client relationship; that arises only on signature of an engagement letter.
Accuracy
Reasonable care is taken to keep this website accurate and current. The law changes, and no warranty is given that content is complete or up to date at the time of reading. To the extent permitted by law, no liability is accepted for loss arising from reliance on website content, as distinct from advice given under an engagement letter.
Intellectual property
The content, branding and design of this website belong to Filippi Legal Consultancy. Pages may be read, printed and shared for personal, non-commercial use with attribution. Any other reproduction requires written permission.
Links
Where this website links to external sites, including government and regulatory sites, those sites are outside the Consultancy's control and no responsibility is accepted for their content.
4. Engagements
Every engagement is governed by the Consultancy's Terms of Business together with an individual engagement letter, both of which take precedence over the content of this website. Where the engagement letter and the Terms of Business conflict, the engagement letter prevails. Before a matter is accepted, a conflict-of-interest check and client identity verification are carried out. Matters falling outside what an unregulated provider may lawfully undertake are declined, and a referral to a regulated professional is made where one is better placed to assist.
5. Governing law
These terms, and any dispute arising from the use of this website, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, save that nothing in this clause affects any statutory right a consumer may have to bring proceedings in the courts of their place of residence.
